Terms of Sale (ToS)

1. Scope of Application
These Terms of Sale (hereinafter "ToS") govern the contractual relationships between IACrea SAS, registered with the RCS under SIREN number 941695157, whose registered office is located at 60 RUE FRANCOIS IER, 75008 PARIS, France (hereinafter "the Seller") and persons making a purchase through the Clipcrea service (hereinafter "the Customer"). These ToS apply to the exclusion of all other conditions. They are accessible at any time on the site and shall prevail, where applicable, over any other version or any contradictory document.
2. Services Offered
The Seller offers a service for creating classic video montages or with artificial intelligence (AI) allowing notably to animate photos into videos. The Service is accessible under different plans: • A free offer with limited features • Paid subscriptions (monthly or annual) with extended features The main characteristics of the services are presented on the site before subscribing to a plan.
3. Prices and Pricing
All prices are indicated excluding taxes. Applicable taxes will be added to the final price at the time of payment, according to current legislation. The Seller reserves the right to modify prices at any time, but services will be billed based on the rate in effect at the time of order.
4. Order
The order is made directly online on the Site after the Customer has created an account. When placing an order, the Customer agrees to provide accurate and up-to-date information. By validating their order, the Customer accepts these ToS in their entirety. Any order is final and cannot be cancelled, except for contrary provisions provided by law (for example, in case of right of withdrawal).
5. Payment
Payment is due at the time of order. It is made online by credit card or via any other payment method offered by the Seller, notably through the online billing service Stripe. For monthly subscriptions, the Customer agrees that the Seller will automatically charge the subscription amount each month, on the anniversary date of the subscription, until cancellation of the subscription by the Customer. The Customer is responsible for keeping their payment information up to date. In case of failed payment, the Seller reserves the right to suspend access to services until regularization.
6. Service Delivery
Credits or subscriptions are activated immediately after payment confirmation by the payment provider (Stripe). The Client can then use their credits to generate videos on the Site. Any unused credits are non-transferable.
7. Subscription and Termination
Subscriptions, whether monthly or annual, are automatically renewed at the end of each cycle without commitment period. The Customer can cancel their subscription at any time from their personal space on the Site. Termination takes effect at the end of the current billing cycle, and unused credits are reset to zero. Annual subscriptions benefit from a discount but are not refunded pro-rata in case of early termination.
8. Withdrawal and Refund
In accordance with Article L221-28 of the Consumer Code, the services offered on the Site are immediately consumable digital services. As such, the Customer waives their right of withdrawal once the purchase is validated and credits or subscriptions are activated. No refund will be made.
9. Customer Service and Complaints
For any questions or complaints regarding the services, the Customer can contact customer service at the following email address: contact@clipcrea.com. The Seller undertakes to respond to Customer requests as soon as possible.
10. Liability
The Seller cannot be held liable for any direct or indirect damage resulting from the use of the Site, services or products sold. The Customer is solely responsible for the use they make of the generated videos and the consequences that may result, particularly regarding respect for intellectual property rights, such as copyright, trademarks or third-party image rights. The seller cannot be held responsible in case of illegal or unauthorized use of videos by the User, and the User agrees to indemnify the seller in case of claim or legal action by third parties resulting from the use of generated videos. Furthermore, the seller does not guarantee that videos generated by artificial intelligence algorithms meet specific expectations in terms of quality or accuracy. Results may vary depending on the reference images provided by the User. It is the User's responsibility to ensure that the generated videos are appropriate for the intended use and comply with applicable laws.
11. Force Majeure
The execution of the Seller's obligations is suspended in case of occurrence of a fortuitous event or force majeure that would prevent its execution. The Seller will notify the Customer of the occurrence of such an event as soon as possible.
12. Intellectual Property
All elements of the Site are and remain the intellectual and exclusive property of the Seller. The Customer is prohibited from reproducing, exploiting, redistributing, or using in any way whatsoever, even partially, these elements without the prior written authorization of the Seller.
13. Personal Data
Personal information collected during registration and use of services is processed in accordance with the Site's Privacy Policy, accessible at any time.
14. Applicable Law and Jurisdiction
These ToS are governed by French law. In case of dispute and after attempting amicable resolution, French courts shall have exclusive jurisdiction.
